1. As a part of the Patrol's ongoing program to remove intoxicated drivers from the highways, Troop G will utilize sobriety checkpoints to supplement our DWI enforcement program. We will organize and execute a checkpoint enforcement action on June 22, 1996.

2. The sobriety checkpoint primary site will be on MO 95 at Jct. of Gumbo Road and Sunny Slope, South of Mountain Grove, Missouri with an alternate location of MO 5 South of Mansfield, Missouri, in Wright County. Briefing will be conducted at 2200 hours at the Zone Office in Mountain Grove with the check to commence ediately following until 0400 hours on June 23, 1996.

3. The above location was selected by the Troop G zone supervisors and is based on the high number of alcohol-related traffic accidents and/or the number of drinking driver arrests made previously in this area.

4. The personnel scheduled to conduct the checkpoint will be paid overtime from Division of Highway Safety funds and hours worked will be reported on form SHP-756 and forwarded to the Budget and Procurement Division.

6. The following procedures are mandated by court rulings and Patrol regulations; therefore, it is imperative the procedures be followed as outlined:

a. As warning devices, a patrol car will be parked on each shoulder with its red lights and emergency flashers operating. (All other patrol cars will be parked so as not to obstruct traffic or vision of motorists.) A lighted flare will also be placed on each shoulder of the roadway adjacent to a "Sobriety Checkpoint Ahead" sign.

b. Every car will be stopped unless the volume of traffic is such that it creates a hazardous situation. If this occurs, the OIC will allow all motorists to proceed through the spot check without stopping until the potential hazard is eliminated. The officers will then resume stopping all cars.

c. Every driver will be asked for his driver's license and/or proof of insurance.

d. if any evidence or action which would indicate that the person has been drinking is observed ASK THE SUBJECT IF THEY HAVE BEEN DRINKING.

e. If any affirmative evidence action, or response by the driver is noted, he/she will be asked to step from the vehicle. The vehicle will then be moved from the traveled portion of the roadway by an officer or Another authorized driver.

f. The driver will be escorted to a position of safety and three Field sobriety tests conducted on the subject, i.e., gaze nystagmus test, walk and turn, and one- leg stand.

g. If the field sobriety tests are not performed satisfactorily, the driver will then he Arrested and transported to the appropriate facility for the administering of the breathalyzer test. In the event the B.A.T. vehicle is used, drivers will be processed At the site prior to transport to a holding or bonding facility.

7. If traffic problems arise or any other unforeseen difficulties occur at the primary site, the OIC will make the decision to move the operation to the designated ed alternate site. The officer in charge may adjust the hours of operation to accommodate such things as traffic flow, weather, etc. Troop headquarters shall be notified of said changes by the officer in charge.

8. The OIC or assistant OIC will prepare SHP-281A on all activities, and forward to Troop Headquarters.
