CLERK, U.S. DISTRICT COURT
MIDDLE DISTRICT OF FLORIDA
JACKSONVILLE, FLORIDA |
Case No. 98-137-Civ-J-20C
THE FOREST SERVICE of the United
States Department of Agriculture, et al.,
Defendants.
ORDER
Before the Court is Plaintiffs' Emergency Motion for Temporary Restraining
Order to Enjoin and Prevent Readblocks and Other Enforcement Tactics Deterring
Public Access to Ocala National Forest (Doc. No. 2, filed February 13,
1998). The allegedly illegal activity complained of is said to have taken
place on February 6-7, 1998 and on various dates in February 1997. The
instant motion was not filed until February 13, 1998. Therefore, the Court
refuses to treat this motion as an emergency motion to be acted upon without
notice to the Defendants and without a hearing. Accordingly, Plaintiffs'
Motion for Temporary Restraining Order is converted to a motion seeking
a preliminary injunction.
TAKE NOTICE THAT this matter is set for hearing on Friday, February
20, 1998 at 3:00 P.M. Plaintiffs shall immediately serve a copy of this
Order on the Defendants, and shall note their obligations found within
Local Rules 4.05 and 4.06 of the United States District Court, Middle District
of Florida.
DONE AND ORDERED at Jacksonville, Florida, this 13th day of February,
1998.
